Successful UK Visitor Visa Application Following a Previous Extended Stay

Background
Our client is an elderly Iranian national and widow, with close family ties to the United Kingdom. Her daughter is a British citizen residing in the UK, and her son lives in Switzerland. The client had previously been granted a UK Standard Visitor visa in 2024, which she used to visit her daughter. Due to family circumstances, including an unexpected reunion with her son, she remained in the UK longer than initially planned but left well within the six-month validity of her visa, fully complying with the Immigration Rules. When the client wished to apply for a further visitor visa, she was understandably concerned that the length of her previous stay, coupled with errors made in her online application form, might negatively affect the outcome. She instructed our team to prepare and submit a robust, transparent application addressing these concerns head-on.
Our Challenge
Following a detailed review of the client’s immigration and personal history, we identified several risk factors that required careful handling:
A discrepancy between the intended travel dates declared in the previous application and the actual duration of stay in the UK
The length of the previous visit, which included the Christmas period
A historic visitor visa refusal disclosed on the application form
Inadvertent errors in the financial section of the online application
Complex financial circumstances involving pension income, rental income and family support from overseas
Banking restrictions affecting international transfers to Iran
While none of these issues amounted to a breach of immigration rules, they required clear explanation and strong supporting evidence to avoid refusal.
Our Approach
We adopted a strategic and transparent approach, focusing on credibility, consistency and full disclosure.
Our work included:
Preparing a detailed legal representation letter clearly explaining the previous length of stay and confirming full compliance with visa conditions
Demonstrating that the client is a genuine visitor with no intention to live in the UK through frequent or successive visits
Correcting and clarifying errors made in the online application form before a decision was taken
Evidencing the client’s strong ties to Iran, including long-term residence, family members, property ownership and cultural connections
Presenting a clear financial picture, supported by bank statements, pension records, rental agreements and explanations of third-party family support
Confirming that all costs of the visit would be met by the UK-based sponsor, who had sufficient funds to fully support the trip
We ensured the application aligned closely with Appendix V: Visitor, particularly the genuine visitor and financial requirements.
Our Outcome
The application was presented in a clear, well-structured and honest manner, allowing the Entry Clearance Officer to easily understand:
Why the previous visit was longer than initially planned
That the client complied fully with immigration conditions
That she has strong personal, financial and family ties to Iran
That she has a genuine, temporary reason for visiting the UK
The application was successful, and the client was granted a further UK Standard Visitor visa.
Our Impact
As a result of our involvement:
The application was approved without further queries, including our client had not been interviewed by the Entry Clearance Officer
Concerns arising from the previous visit were resolved without refusal
The client avoided the stress and cost of a potential refusal
The client now has a clear understanding of how to structure future visitor visa applications safely and compliantly.
Summary
This case demonstrates that a long previous visit or application errors do not automatically lead to refusal if they are addressed properly.
By taking a proactive, honest and well-evidenced approach, we were able to show that the client remained a genuine visitor who complied with the UK immigration rules and intended to leave the UK at the end of her stay.
