Successfully Challenging a Sponsor Licence Revocation

Our Challenge
Our client, a UK care provider, contacted us after receiving a Home Office decision revoking its Skilled Worker Sponsor Licence following a compliance visit. The revocation was based on concerns regarding sponsor compliance duties, including reporting obligations and internal sponsorship processes. The most serious allegation was the use of the Authorising Officer’s email address by a 3rd party.
The decision placed the organisation in a difficult position. Without a sponsor licence, the business faced significant operational challenges and uncertainty regarding its existing sponsored workforce.
Our Solution
Our Business Immigration team was instructed immediately following the revocation decision. We carried out a detailed review of the suspension and revocation process, the Home Office's findings, and the extensive evidence previously submitted by the client in response to the suspension notice.
During our review, we identified that the Home Office had placed significant reliance on an alleged admission said to have been made during the compliance visit. However, despite repeated requests made by both the client and our firm, the Home Office failed to provide copies of the contemporaneous interview notes and the Compliance Visit Report relied upon when reaching its decision. Requests for disclosure were made on numerous occasions, including throughout August and September 2026, yet the records remained unavailable.
Recognising the importance of these documents, we pursued the matter extensively with the Sponsor Licence Team and lodged further requests seeking disclosure of the underlying records. We also worked closely with the client to obtain supporting evidence addressing the Home Office's concerns, including witness evidence, corporate records, sponsor compliance documentation and technical evidence relating to systems and controls.
Following a detailed legal analysis of the decision, we concluded that there were serious concerns regarding procedural fairness, the assessment of the evidence, and the conclusions reached by the Home Office. We therefore prepared and submitted a comprehensive Pre-Action Protocol Letter challenging the lawfulness of the decision and inviting the Secretary of State to withdraw the revocation and reinstate the sponsor licence.
Our Outcome
Following receipt of our Pre Action Letter, the Home Office reviewed the matter and accepted that the revocation decision had been incorrectly reached. The Secretary of State confirmed that the decision would be reconsidered and that the sponsor licence would be reinstated whilst that reconsideration was ongoing.
This outcome enabled our client to continue operating as a licenced sponsor, protected its sponsored workforce, and avoided the need to commence Judicial Review proceedings before the High Court.
